Terms of Service

1. Acceptance of Terms

By accessing or using ABA iNote ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including Registered Behavior Technicians (RBTs), Board Certified Behavior Analysts (BCBAs), BCaBAs, and organizational administrators.

2. Description of Service

ABA iNote is a clinical documentation platform designed to assist ABA therapy professionals in generating, storing, and managing session notes, supervision records, and related clinical documentation. The Service uses artificial intelligence to assist with note generation; all generated content must be reviewed and verified by a qualified clinician before use in any official record.

3. User Responsibilities

You are solely responsible for: (a) the accuracy and completeness of all information you enter into the Service; (b) ensuring that AI-generated notes are reviewed and corrected before submission to any payer, employer, or regulatory body; (c) compliance with all applicable federal and state laws, including HIPAA, applicable state privacy laws, and your professional licensing board requirements; (d) maintaining the confidentiality of your login credentials; and (e) ensuring that any client whose information is entered has provided appropriate authorization for the collection and use of their protected health information (PHI).

4. Prohibited Uses

You may not use the Service to: (a) submit fraudulent, false, or misleading clinical documentation; (b) access or attempt to access another user's account or data; (c) reverse engineer, decompile, or disassemble any portion of the Service; (d) use the Service in any manner that violates applicable law or professional ethical standards; or (e) share your account credentials with any third party.

5. AI-Generated Content Disclaimer

The AI note generation feature is a documentation aid only. ABA iNote makes no representation that AI-generated content is clinically accurate, complete, or appropriate for any specific client. You acknowledge that you are a licensed or supervised clinical professional and that final responsibility for all documentation rests with you. ABA iNote is not a substitute for professional clinical judgment.

6. Data Ownership

You retain ownership of all client data and clinical records you enter into the Service.ABA iNote does not claim ownership of your data. By using the Service, you grantABA iNote a limited license to process your data solely for the purpose of providing the Service to you.

7. Limitation of Liability

To the maximum extent permitted by applicable law, ABA iNote shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to errors in AI-generated documentation, data loss, or regulatory penalties. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

8. Termination

We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms or applicable law. Upon termination, you may request an export of your data within 30 days.

9. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Palm Beach County, Florida.
